Privacy Policy & Client Terms of Service

Motex Technologies designs, develops, and delivers custom software — including mobile apps, desktop applications, and supporting systems — for clients on an end-to-end basis, from initial scoping through delivery and post-launch support.

Every engagement begins with a scope of work outlining deliverables, timeline, and cost, agreed upon in writing (email or signed document) before development starts. Any work outside the agreed scope is treated as a change request (see Section 6).

Clients are expected to provide timely feedback, required content (branding assets, text, credentials for third-party services, etc.), and access needed to complete the project. Delays in providing these may extend the project timeline accordingly.

• Projects are typically billed via an upfront deposit followed by milestone or completion-based payments, as agreed per project.
• All fees are quoted in Zambian Kwacha (ZMW) unless otherwise agreed.
• Work products (source code, builds, deployment) are released to the client upon receipt of full payment unless a different arrangement is agreed in writing.
• Late payments may result in a pause of active development work until resolved.

• Upon full payment, ownership of the custom code and deliverables developed specifically for the client's project transfers to the client.
• Motex Technologies retains the right to reuse general-purpose components, internal tools, and non-client-specific code (e.g. shared libraries, boilerplate patterns) across other projects.
• Any third-party libraries, frameworks, or services used remain subject to their own licenses.

A reasonable number of revisions are included as agreed in the project scope. Requests that expand the original scope (new features, redesigns, additional platforms) are treated as change requests and quoted separately before work begins.

We treat client business information, data, and materials shared during a project as confidential, and do not share them with third parties except as required to deliver the agreed service (e.g. necessary third-party infrastructure providers) or as required by law.

Where a project involves handling personal data (e.g. customer records, guest lists, transaction data), Motex Technologies follows applicable Zambian data protection requirements, including registration and compliance obligations under the Data Protection Commission (DPC) where relevant to the client's application.

We fix bugs directly resulting from our development work at no additional cost within an agreed support window following delivery (as specified per project). Support beyond this window, new feature work, or issues arising from third-party changes (e.g. platform/OS updates, third-party API changes) are handled as separate paid engagements.

Timelines quoted are estimates based on the agreed scope and timely client cooperation. Delays caused by late client feedback, late payments, or scope changes may extend delivery dates, and we will communicate any impact as soon as it's known.

Motex Technologies delivers software to an agreed specification and tests it accordingly, but does not guarantee that software will be entirely free of defects. We are not liable for indirect or consequential losses arising from use of delivered software beyond correcting defects covered under Section 9.

Either party may terminate an engagement with written notice. The client is responsible for payment for work completed up to the termination date. Any deposit paid is non-refundable once development work has begun, unless otherwise agreed.

These terms may be updated as our services evolve. Continued engagement with Motex Technologies after changes are published constitutes acceptance of the updated terms.

These terms are governed by the laws of the Republic of Zambia.
